Roundup Lawsuits Growing

I have filed six Roundup lawsuits against Monsanto, the manufacturer of the world’s most popular weed killer, alleging it caused my clients’ Non-Hodgkin’s lymphoma. All of them used Roundup to kill weeds in their yards over a period ranging from 10-40 years. My clients live with this non-curable cancer and the fear that it might come back.

The number of Roundup lawsuits is growing. I anticipate this will be one of the biggest mass torts ever. Nationwide, lawsuits have already been filed on behalf of over 16,000 consumers. In the upcoming weeks, I anticipate filing additional lawsuits on behalf of injured consumers.

Roundup Lawsuits

Nationwide, three lawsuits went to trial and were found in the consumers’ favor. The juries concluded glyphosate, the active ingredient in Roundup, caused or contributed to their cancer. The lawsuits uncovered how Monsanto deceived the public with misleading and false advertisements about the safety of Roundup products, including one advertisement that claimed, “Roundup is as safe as table salt.” Court documents revealed the company misled scientists and the public with company-created studies supporting the products’ safety.

Punitive Damages

In all three cases, the juries awarded punitive damages. Punitive damages punish a company when it acts in a way that is either intentional or reckless and likely to cause death or serious bodily injury. In these instances, Monsanto misrepresented and withheld information that glyphosate is likely carcinogenic.

The company covered that fact up so people couldn’t learn about potential risks. A cancer warning should have been placed on the products’ warning labels to give consumers the ability to make an informed decision about using the product; this has been done with many other potentially carcinogenic products in the past, for example, products containing saccharine.

EPA: No Warning Labels

Despite the fact that in 2015, Roundup’s active ingredient, Glyphosate, was classified by the World Health Organization’s International Agency on Cancer as “probably carcinogenic to humans”, last month the EPA refused to require Monsanto to put warning labels on Roundup about glyphosate and its cancer risk.

Consumers at Risk

As a result of the EPA’s inaction, the public’s health is at risk because Roundup is ubiquitous and many consumers don’t know about the connection between Roundup and Non-Hodgkin’s lymphoma.

I believe Roundup products should be pulled from shelves and, at the very least, required to have a warning label alerting users to the products’ potential cancer risk. I recommend consumers not buy Roundup, but instead, look for alternative glyphosate-free products by reviewing product labels. Using weed-resistant native plants to avoid needing weed killer is another option.
