Vaccine Court Unanimously Rules that Vaccines Can Not Cause Autism:  Thousands of Cases are Dismissed

 

Beginning in 2003, cases were filed in the Vaccine Court under the Omnibus Autism Proceeding (“OAP”) alleging that thimerosal containing vaccines  either alone or in combination with the measles-mumps-rubella vaccine (“MMR”) caused children to be diagnosed with autism and or injuries on the autism spectrum.  Over 5,000 such cases were filed on behalf of injured Petitioners across the United States.  Six test cases were chosen to be tried.  Unfortunately, the Vaccine Court unanimously ruled in all six cases, which was affirmed by the United States Court of Federal Claims, that vaccines cannot cause autism.  The significance of these six case decisions is that without more scientific proof, Petitioners will not be able to establish or prove that vaccines can cause autism.  Consequently, thousands of cases filed under the OAP are having to be dismissed.  All of the decisions affecting cases in the OAP can be found at the website of the United States Court of Federal Claims.  Go to www.uscfc.uscourts.gov/node/5026.
